I'd say both just to be safe. Tattooing is artistic and many artists create original designs for people, no matter where they end up. BUT many people draw their own tattoo designs, and therefore are the original creator, and the tattoo artist is just copying it onto their body. If the owner of the tattoo decides to make a case out of it, I'd say they might have one. If someone is letting you photograph their tattoo though, I doubt they'd shy away from signing a release.
