This is where you missed my point...for someone to do what they did as you stated above, would be in violation of the terms if they didn't pay the P-EL. This is a viable case to present in a court of law and it would be in our favor.



However, if a product is sold--they have the right to resell the very product they bought. Dreamstime here is basically implying this: if you buy a print from here, you cannot do anything with it except to use it or throw it away. That will not hold in a court of law, sorry.



My point is simply this: there is a significant difference between the two that one is prosecutable in a court of law and the other isn't.

I don't understand why you guys are making such a big deal for a simple request: an "opt out" feature. I'm not saying you should opt out--that is your right, your own decision. I want to opt out some of my photos (not saying all of them--especially my 9/11 photo)--and I'm getting the feeling you're becoming all republican on me--imposing whatever you think is appropriate for me, whether I like it or not.

Anyway, I think the only "blurred line" about this is that Buyers are more likely to get a better price on a print through DT than they would through other printing companies in that DT does not have to purchase the P-EL for print. My question then is. . . "How will this affect the amount of P-EL licenses downloaded once buyers (and printers) compare prices and/or cost and ability to compete?" . . . Only time will tell. Let me make this perfectly clear, I completely understand that all RF images that have been downloaded in the past we're made into prints of some type (or for websites - that's obvious) so in that respect nothing is different. So as a contributor, this could be a Good Deal, or a Bad Deal. Prints offered for resale to the general public (via DT) at a RF maximum would be a bad deal for images that had only 'some' mass resale potential and in which printers were somewhat inclined to 'take a chance on' and offer for resale to the general public. Now that they are offered as RF prints on DT, this could mean printers are less likely to take a chance on the image since it's already available via DT? Meanwhile, it could be a SMOKIN' deal for images that are so freakin' hot that P-EL licenses were flying off the self because NOW RF prints would potentially fly even faster. Approximately 100,000 RFD prints would equal the revenue of 10,000 more expensive P-EL. Which is easier to sell? So, would this mean printing companies would STOP buying the P-EL licenses once they crunch the numbers and find they are unable to compete with DT? Remember if a printing company were to purchase an image for the purpose of reselling it as a print to the general pubic (even if they ONLY sold ONE print) they are required to purchase the P-EL. That is how it was explained to me. But even then none of this matters if the general public doesn't "get wind" of the fact that they can get a better print price here on DT (potentially) than at their local print shop offering the same image. On the other hand this is also a great deal for contributors that do not have that 'Monet' or Rembrandt in that all 6.6 million images on DT are now available for print at a reduced rate so potentially more downloads for print. . . hey it all adds up. This lower price for print 'here' on DT could potentially mean higher RPD overall for contributors. I also understand that DT must continue to compete with other Stock websites. It's a fine line for DT. So in summary my thoughts are that DT's offering items for print shouldn't affect most CONTRIBUTORS in a negative way, unless these contributors are also printers that offered prints for resale. It could very well discourage printers from downloading images with a P-EL license. But I'm guessing that there must not have been many P-EL's sold or DT would have taken that into consideration. The only question that remains is how does the revenue for print on DT now compete with the revenue for contributors on CafePress or Zazzle (for example)? This new feature now puts DT in their sandbox too. Whew that's a mouthful. I apologize for the long post. Have a great day :-)

Thank you. It is absurd to assume that buyers of prints would simply throw the canvases away once they've tired of its use.



Why isn't DT paying P-EL for the use of our photos in this manner. I mean, they're making more profit out of selling prints now--shouldn't they abide by the very rules they've created for everyone else?

The program is still in a beginning phase so it's early calling it a success or not. It all depends on the expectations. This was never supposed to be a competing factor to our core model, but rather an additional vertical model.



As the potential print buyer is very different from our regular customer base, this needs time. At this point we're still studying the impact, the logistical capabilities and other factors, things which will determine its capabilities for the long term.

PS: on a different note, we see a strong interest for SR-EL licenses. Nov 2009 looks to have over 400% YoY growth compared to Nov 2008 for this type of licensing. We receive many requests from buyers asking contributors to enable SR-EL. Many of them don't contact us, so make sure you enable the SR-EL license on all files that you are able to. Unlike prints or p-els there is no pattern for what makes the average SR-EL subject wise. Anything can sell.

the highlighted sentence caught my eye. I hope I am not at risk here. Not really sure what you were talking about with the "that you are able to" part? Is it alright to have SR-EL enabled if the images are available at other sites?

They don't have to be exclusive. You just need to be able to remove them in maximum 72 hours if you get such sale (image is removed automatically from Dreamstime).



Stuart, I'm waiting for mine too. Not everyone is receiving them, but everyone has a fair chance!

I have received yesterday the canvas I have ordered a few weeks back. There was a problem with the package delivery and it had returned to dreamstime once. I can only speculate that the reason might be the situation of TNT deliveries here in Switzerland, which are actualy taken care by SwissPost. Fortunately, the second atempt reached the destination and I am now in the possesion of a gorgeos large size canvas of an Amsterdam shot from my portfolio.



We are having some guests over these days, so I cannot start drilling holes to hang it on the wall just yet, but I'll do this as soon as I can find the time. Pictures will follow... In the meanwhile we will probably order some more...



On the visible side of the canvas there is no trace of dreamstime logo's or author of the image, which is good. On the back, dreamstime logo and a bar-code are visible on the extra canvas. However there is no trace of the author's name, file ID, file title or date, which is bad. May I suggest to add some information about the author of the image on the back of the canvas or print either directly by printing, or by additional sticker or something?
