As I understand it, the contributor isn't legally obligated to fill it out however, for reporting purposes, DT or any agency would be legally required to collect it from them in order to sell their images to US buyers on their behalf.

I'm very confident that DT will find a way out, as the other sites did (for instance the one owned by papa Bill Gates). Probably have to find the right tax experts in the US.

We shouldn't underestimate the nightmare this poses for DT too. Programming the tax center, more resources needed to track sales, more bookkeeping, more load on support, checking forms. Just a tap on the shoulders guys. ;-)

Well, on RM you can set geographical distribution, but on microstock it's not habitual. Imagine the overhead on the databases. I don't like to pay taxes to a foreign government as much as you do since it's taxation without representation. But what can we do? Just move on and keep making images, I guess. Let's just give DT a break for now. I'm sure they're working on it around the clock. Don' worry, be happy. ;-)

Peace!

I'm willing to comply and fill out W-9 but is site secure ? I'm concerned about identity theft. Can I mail form? What other options do I have ? Form page doesn't show https that a secure site would have.

I´m in Germany and pay my taxes in Germany (treaty country 0 %).

Is it right that I only have to fill in the W-8BEN and leave point 6 empty (so I did at other agencies and it worked) and my earnings will be paid without deduction of tax?

I already hold a Certificate of Foreign Status from a completed W-8BEN through another USA stock agency with the relevent IRS Ref No.

As this certificate is non specific to any particular agency, why can,t I use this one for my Dreamstime Account. Instead of duplicating another one with IRS.

This would simply mean giving Dreamstime my Certificate No which is alrady registered with IRS, just can,t understand why we have to fill another W-8BEN application.

This is correct, but the Dreamstime version of W-8BEN looks slightly different from the one I filled in with another stock agency. The one attached in the Tax Center seem to be a 2006 edition, dont know if this is the up to date one.

Perhaps we can have some advice on these 2 points.

Me too, before I was exclusive to DT.

Perhaps all those contributers with other agencies could politely ask them how they get round the issue?

After 15.09, ALL earnings I have, including those earned before 15.09, will be taxed? Or is it like this, that let`s say i have currently $100 of earnings and in second half of September i will earn another $10 (from US buyers). At the end of Sept. i will withdraw all $110. Then, will the whole $110 is taxed or only that $10 i earned after 15.09 is taxed and rest $100 is tax-free?

No,

we will apply the withholding treaty tax ONLY for your earnings made AFTER September 15. So if you're request your payment on September 16 or a later date, the total amount of the earnings made before September 15 is not affected by any taxation.

It would be nice if we could take our money now without waiting 100$and i also think that buyer must pay taxes, because usually if i sell something to US resident, im not responsible for taxes, buyer is the one who must pay it.

As I said your earnings made before September 15 are not affected by the withholding tax even though you will request your payment after Sept 15.

If it has, can you please confirm that if we fill out the form without the ITIN and without the applied for option, that we will be only taxed the treaty percentage.Thanks.

Yes you don't need to tick the 'applied for' radio button. You can leave the ITIN field blank and for all earnings made after September 15 the treaty percentage will be applied, in you case 5% (of course ONLY for earnings made from US buyers)

What a pain and how time consuming to have to read 10 pages of messages just to find out the current position regarding completion of this bloody tax form.

Please, please - is there any chance of DT posting a message here that compiles all the advice given above as replies to queries into one easy to read message (or post an update on the tax advice page) so we can complete the form as required by DT in a way that relates to a treaty or non-treaty country?

IMO Tano's last replies answer all confusing questions. Just read them through and it all should be understandable.
