Hi,

I have compiled other W-8BEN forms and for Italy part 10 was as follow



10. Special rates and conditions (if applicable):

The beneficial owner is claiming the provisions of Article 12(2) of the treaty identified on line 9a above to claim a 5% rate of withholding on (specify type of income): Royalty income - Images/Other



But in your on line form the Article is 12(3) and the claim is 0%.

@sunnymars. You should submit the W-8BEN form and use the "applied for" option until you have your ITIN number. If we have these, we won't withhold 30% but the 5% according to the tax treaty, assuming you will get the ITIN. When you receive the ITIN number, you should email support and we will replace it for you.



@Illerent, I would guess that the country of fiscal residence should be used, but I suggest to ask your tax advisor.

This was already happening at other two renowned agencies. I recall that for weeks it brought up a really great mess and vibrant protests and confusion, until they found out that ITIN was not necessary, but only the form W8-BEN.

I think that the same should apply to DT. So, before submitting my form (without ITIN) I will be waiting the developments, because I suppose this will be a 'hot' september in Dreamstime! ;-)

I hope you're right.

I think I'll wait a while, before I fill in my W8-BEN, let the dust settle.

I think you are wrong here and I've seen this so many times elsewhere. If I apply for an ITIN number, the IRS will reject my application and will request an original letter signed from the agency (DT) to be sent with the application. An ITIN form is not required anyway because 1) I am not a resident or non-resident alian required to fill out a US tax return.



I think DT will end up in a bit of trouble if they start withholding 30% tax on those who sent in their W-8BEN form.



I'm telling you right now, I will not be applying for an ITIN because I do not need to apply for one and should only be taxed 5%.



DT needs to get their facts straight and I will not send in any form till they do.

Just submitted my form. When submitting the form correctly reflected the article 12(1) and rate 0% for Switzerland where I reside. But when I look at the submitted form it now states article 12(2) with a rate of 10%.

What went wrong and can this be corrected?

As the ITIN number is not required is the form being changed so that this does not need to be completed?



Also as you already hold photo ID does this need to be uploaded again? Can't you link that from your database?





Not wanting to cause trouble these changes would save time and cause you less grief.

It shouldn't ask it if I enter SSN

Yes, I also remember it - on these stocks we initially were requested to obtain TIN, but, after the IRS was overloaded by hundreds of TIN applications from the whole world and necessity for the stock to provide all the applicants with the individual letters confirming the type and origin of income, they immediatelly stopped this exercise and allow all contributors to file their tax-exemption forms without any TIN.

I know this is not a good news Achilles but thanks to you guys that DT almost came a year later than the first stock agency that started this. We atleast saved money for the last year. :)

I'm exclusive here and I don't know this procedure, but I also think we don't need an ITIN (we don't pay tax in U.S./I'm Italian). So... we have to wait for new developments and a new W-8BEN?

Hello, I'm living in Italy. I tried to compile the module, but I can not complete it because they appear the following error messages: "Please specify the Taxpayer Identification Number. Please specify the foreign tax Identifying number". There is no need for an Italian to have a ITIN or otherwise. How do I complete the form?
