Ok, I've tried reading the different licenses, and I"m still confused. In addition to being a contributor here at DT, I am also a designer of digital scrapbook kits. As such, here is the question:

If a Digital Scrapbook designer purchased an image and wanted to use that image to create an item (element or paper) that would be included in a digital scrapbook kit, what license would that designer need to purchase, as the item would be in digital form, sold in a kit to a customer that would use them for scrapbook layouts, not sold directly in printable form?

This is probably a new venue for this company, but it's a viable one if the proper licenses are available to them.

Do you mean you would be creating a CD of dreamstime images that would be redistributed and where you would not have control of their use?

A better idea might be to provide links and recommendations to dreamstime in a manner that would get you the referral fee from Dreamstime when users subscribed. That would provide residual income to you beyond the first sale of the scrapbook package and give your buyers access to the current library. Millions of images and not just the limited number you could package. You could even provide some sample search requests that would bring up particular categories, flowers, sunsets, etc.

No, what I mean is that the purchaser would be taking an image from dreamstime and creating a PS or PSP brush to create a digital file that customers could use as a background paper for scrapbooking etc. The file would not be resold in it's original form at all.

For those that are unfamiliar with what I'm talking about, you can see some of my kits here that I've used texture photos that I've taken to create papers, photos of flowers to create flower elements for kits, etc....

The image above used a texture photo to create a brush in PS that I used to create the mottled design on the brown, burgundy, green and pink papers in this kit.

In this kit, I used photos of flowers that I had to create the papers in this set. The flower is permanently fused in the file with the background, so the photo of the flower is not being sold, it's being used to create something else that is being sold. Same with the texture brush.

KWIM?

The photos they purchase, however, need to be licensed as such so that they can make an income off it. It needs to be commercial use ok, so that when they create something and sell it, they're not getting in trouble for using a copyrighted image for their monetary gain. The digital scrapbooking designers in this community are very 'copyright' conscience, as they create things that they own the copyright on, and are dealing with pirates in their own industry.

You need the web extended license for this type of usage and you need to make sure that you don't go over 10 000 sales of one design, as per the terms and conditions of the web extended license.
Also, your buyer would not be able to sell your work forward because it also contains images licensed from Dreamstime, so he would only be able to use it for him or herself.
