It's the likelihood that the image might confuse the public's perception and make them think they are buying a product from one company when in fact they're buying it from another. And don't forget, there might be an appeal with a different outcome.....a higher court might disagree with the current decision and overturn it. Re Ansel Adams - if he had coloured a tree red in a monochrome landscape image and another photographer, using the same landscape view also coloured a tree red, it is likely that would be a breach of copyright. But simply taking a shot of the same view, in either colour or b&w, would not breach copyright otherwise the courts all the world would be flooded with cases.As this is not the first time the courts have ruled on these types of issues I don't think we need to be too concerned. posted in \'Similar\' looking image may breach the copyright!
