Digital releases now accepted + change in terms

Starting today, we have adjusted our terms in order to accept digital releases produced by the following apps:
iOS - Model Release, ASMP Release, Easy Release
Android - Easy Release

Each of the apps will make the required fields mandatory so I will not mention them here, you already know them. Thanks to a change in our terms, releases that contain the following paragraph are now acceptable (for both digital and printed MRs):
I agree that this release is irrevocable, worldwide and perpetual, and will be governed by the laws (excluding the law of conflicts) of the country/state from the following list that are nearest to the address of the Model (or Parent) given opposite: New York, Alberta, England, Australia and New Zealand.

Consequently, the following refusal reasons will no longer be used:
Your MR document is governed by the laws of a different country than the model's or photographer's and other than US. The model release represents a written agreement between the model and the photographer, therefore it must be governed by the laws of the country/state where one of the parties resides. Alternatively it can be governed by US laws or international (generic, not country related).

We are cautious about the digital releases for now and we strongly recommend using them only when really needed. A printed document remains the best choice from a legal perspective, especially when outside US. Photographers should check model's ID and ensure the info provided is accurate, especially for candid photos etc. Remember you are responsible for everything you upload, including model releases, so make sure you are protected by the model's future claims, even when you know that person. Especially when you photograph an unknown person do ask for his ID and contact info.

As before, while contributing photographers are not required to use the model release forms that we provide, in the event that you do not use the releases that we provide, you should pay special attention to the terms of the model release that is signed, as this will be the legal document between you and the model. In particular, some standard model release forms contain what are called "choice of law" and/or "forum selection" clauses that specify where disputes between the photographer and the model can be brought and what countries' laws will apply to those disputes. Since Dreamstime is not a party to these agreements (the parties signing the agreement are you and the model), these terms do not apply to your relationship with us. To the contrary, our terms of service outline the legal relationship between you and Dreamstime. Model release terms only apply to your relationship with the model. Dreamstime does not assume responsibility for compliance with any term of any agreement between you and the models that appear in your photos.

This is a good change. I still prefer my paper release, but this will be very convenient for mobile shooters.

Also, the folks who had that MR rejection will be very pleased they can resubmit their images!

As you know I have been using digital releases for a long time now. Bill Clinton signed the Esign Act in 2000 and digital signature is now a part of our daily lives at banks, point of purchase and many many other areas of day to day life. The reluctance of DT to accept the digital signature had led to me ceasing to upload here now I can resume finally.

Really, i know that everybody here knows what digital release is, but i don't. So can anyone clarify this for me? Never heard of it and that is why i am asking.

Best thing since sliced bread. It databases all my release data so that I never have to fill out a release with a particular model more then once. I know DT is still apprehensive about the digital aspect but this is the future. Signing a piece of paper with a pen or signing a touch screen with a stylus is IMO 6 of one half a dozen of the other. I can still print out the PDF for a hard copy if I need it, DT has always gotten scanned digital copies of original release docs anywise so personally I don't see any difference on their end at all.

Photoshow, are you referring to model release uploads or images uploads?
If you are referring to model releases it depends on the developers of the applications to provide a way to submit the MR directly to the stock sites you are uploading to.
Images taken with a mobile phone should be checked on a computer as well, as we do expect the quality to be as good as possible.
On some mobile phones you can use the browser to upload images directly.
An app will be developed but we are looking to offer as many features as possible with it.

Yes I was referring to the upload of Mobil images. If you want the look and feel of over filtered over sharpened Mobil images then the quality is not really going to be all that improved by editing in photoshop. At least not while keeping the qualities that make it a Mobil image.

As far as Mobil upload of model released that is as some as assigning an email address to each contributors model release gallery they could then edit them from the browser to add sex ethnicity and age

It would be greater if DT can also create a form page where photographers can also open from desktop / laptop or send a link to the model for them to digitally fill up and instantly submit. Later, the photographer will get some kind of notification once the submission is accepted.

Hi.
I'll bring back to life this one year old thread.
Today I had some problems with my paper model releases and looking to improve this section of my non-photographic work - I hate it, sincerely! :)

So, I need some info from someone who use Android - Easy Release (about $10 on google store now) and how to avoid mistakes that will eat my time and nerves. Good parts, bad parts about this app. Only some advices, please, also from IOS users, I think the app is the same.
(I have an Asus Transformer 10" tablet if this matter)
