When do we need Property Releases?

Hi guys I always worried about property realeses and that is what i found:

In theory if is for editorial you allowed to upload almost everything because is for educational purposes, as we living on a free country.

However Cuba and China they are bit funny about it.

Did you Know that

The Empire State Building is an architectural marvel, and one of the most striking attractions in New York City. The building itself was constructed during the Great Depression and is a monument to that era and the city it so proudly illuminates. The building is trademarked, and thus isolated shots of the building for commercial usage without a property release is not allowed.

Allowed: Cityscapes including the Empire State Building ARE

allowed. (Note: If the Empire State Building IS NOT the primary subject of the photo, it is permitted for use in royalty-free stock).

The Hollywood Sign is trademarked and may also invite copyright as a sculptural work. Since some usage will require a special property release, it is not suitable for to be used for royalty-free stock.

Exterior and interior shots of the NY Stock Exchange require a property release before they may be used for commercial photography.

Allowed: Cityscapes including the NY Stock Exchange ARE allowed. (Note: If the NY Stock Exchange IS NOT the primary subject of the photo, it is permitted for use in royalty-free stock).

The Concorde requires a property release for commercial photography.

The Louvre is one of the largest museums in the world, holding the rich artistic heritage of the French people from the early Capetian.

Shots of the Louvre exterior should be acceptable, however IM Pei's Pyramid should not be featured in any exterior shots.

Photography and filming inside and outside the Louvre for commercial purposes is prohibited. (including but not limited to all architecture and artwork on the Louvre property)

The London Eye is a structure in London that is part ride, part vehicle, conceived by British Airways engineers. It is permitted to use images of the machine for a broad range of use, excluding advertising - therefor considering it prohibited for royalty-free stock.

Allowed: Cityscapes including the London Eye ARE allowed. (Note: If the London Eye IS NOT the primary subject of the photo, it is permitted for use in royalty-free stock).

Zoological Locations such as Seaword, San Diego Zoo, Busch Gardens, etc - Logos, images from theme parks, shows, attractions, products, animals, productions, characters or wordmarks are all protected and cannot be photographed for commercial use.

For clarity this policy applies to ALL zoological locations.

ALLOWED: A commercial photo of the Eiffel tower by day is permitted.

TRADEMARK: Photograph of the Eiffel Tower's evening light show cannot be published commercially, and is protected by the creator of the show.

ALL dolls, accessory, games, or action figures or product created by Mattel is subject to trademark and patent.

Including: Barbie, Bratz, Fisher-Price and Hot Wheels.

Hi darrins :

What they mean is that you are not allow to sell pictures as comercial. However you can upload them as editorial. Be careful though because may the buyer uses them as comercial, so after you ll be in trouble because the copyright is yours. That is why is better to be exclusive so is much easier to track who bought the pict and dreamstime can use the legal team. If the pictures are in different website no one will take responsibility for. Good luck

I was after some guidance on photos of US military equipement, specifically aircraft and specifically Air National Guard LC-130s. I wrote the Guard and got the following. I believe they may have misunderstood my question or they over-simplified their answer. I did ask for a copy of relevant policy documents, which I'm sure exist, but did not receive. Anyway, here is what I got and if anyone has any more information please let me know.

Classification: UNCLASSIFIED
Caveats: NONE

Identifiable U.S. military people/equipment may not be photographed in order to sell the photos commercially. Further, there are U.S. Federal laws which prohibit the use of military uniforms in commercial endeavors or to use as an implied endorsement of any commercial entity, as well as civil laws which may enter into the equation if there are identifiable individuals and they have not signed a release for the use of their personal image. Maybe because the first one you uploaded was an editorial picture and the others as comercial. Also if the first one wasn't isolated that will be acceptable as well. Like if the main subject was a model for example. Is posible that you put the name of the tower in the keywords and you did not write on the first one.

I had a photo of the Burj Khalifa building in Dubai that was approved. Thinking there were no PR issues with the building, i then uploaded the rest of the files with the same building in which all were disapproved due to PR issues. i am wondering how come i had the an approval on the first photo and the rest had PR issues??? There are also a lot of Burj Khalifa buildings online with no PR's provided.

I was aware of some quirky restrictions such as the one concerning the Hollywood sign or the lights of the Eiffel Tower at night.
Sometimes I've got doubts, though, and I'm never sure were to look for the information. Have you got some useful websites to recommend? Where do you come by the information?
