Found my picture in Joann Fabric Ad!

My sister actually spotted my picture in the new Joann Fabric ad that comes in the paper tomorrow morning. It is of my son which is why she spotted it. I have a question though- shouldn't they have had to buy some sort of extended license in order to put it in an ad of that magnitude? It's online on their ad too. Just wondering if they can do what they did? Thrilled though of course to see my picture in the ad!! :)

Here is the link to the ad and picture: Joann Fabric Ad 2/27/10

I believe that if they didn't exceed 500,000 copies of the image they do not need to buy any license. I don't know what the circulation numbers of this advertising insert might be. Perhaps this page would explain more -

Royalty Free License

"If you use the images for printed materials, the number of copies must not exceed 500,000. You may modify the images in any way required for reproduction, or include them in your own personal creations."

I have to believe that there are more than 500,000 printed ads. They are in all the stores in every state, not to mention in the newspapers. We actually didn't get one in our newspaper but I know of people seeing them in the newspapers in Florida and Oregon. That's two different sides of the US so I have to believe that there were many other states that had them in their papers. I went to our store and got an ad from there that has the picture in it for his baby book. :) It is pretty neat!!

How exciting for you but a little disappointing though maybe huh? You may have shoulda' got a little more out of it I would think, payment wise. Hope you received more than a dollar! I know in Oregon, because I'm from there, we get these adds and they also pass them out in the stores per customer....What do ya do???

Perhaps Dreamstime should follow up on that one?

After all they are the representative agent ??

I dont know the policy when there maybe an issue like this.

Would be good to learn though.
